We would like to inform you, as a valued customer of The Wine Cellar at Bee Cave (your licensed retailer in the state of Texas), that your order may be delayed by up to 10-14 days. Please also note that you will not be charged for your order until it is safely on its way to your delivery address.
The reason for this delay is explained below:
In a recent change in their position, the Texas Alcoholic Beverage Commission (TABC) now contends that the current way your wine is shipped to you (and to consumers throughout Texas) is prohibited. We believe this to be unlawful and - as you'll read - are working hard on your behalf to resume normal service.
We are looking at alternative ways to get your wine to you that will comply with the TABC's new position and only anticipate a small delay. We're very sorry for any inconvenience this causes and appreciate your patience in this matter.
We find the TABC's actions completely unacceptable - not only from our standpoint but also from that of Texas wine consumers. We have therefore initiated a lawsuit against the TABC that is now pending in Travis County Circuit Court.
We believe you, as one of our very many customers in Texas, possess the right to place an order for wine with a licensed Texas retailer and in particular with The Wine Cellar at Bee Cave. Furthermore, you have the right - as an adult - to have your wine delivered to your door or office by a carrier licensed by the TABC, the likes of FedEx and UPS. The TABC is attempting to take these rights away from you without any proper basis to do so.
If you agree with us, we urge you to voice your concern regarding your right to purchase and receive your wine in the same manner as you have in the past. You can do this by emailing the TABC at complaints@tabc.state.tx.us or by contacting your specific legislator - you'll find appropriate contact information at www.fyi.legis.state.tx.us.
